Terms & Conditions
By accessing and using our services, you agree to comply with the terms set out by ELENAX. All deliverables, including designs, videos, and digital assets, remain the intellectual property of ELENAX unless otherwise agreed in writing. Quotations are based on the scope agreed upon and are subject to adjustments in compliance with regulations or tax changes.
Clients are responsible for providing all necessary materials (e.g., company info, visual assets, service descriptions) on time. Service timelines commence only after full payment and receipt of all required content. Any work beyond the agreed scope, including major revisions or additions, will be quoted separately.
Elenax shall not be held liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, or service interruptions.
Cancellation & Refund Policy
All deposits and confirmed payments are strictly non-refundable if the client cancels. Suppose a project is cancelled after commencement. Still, before publication or completion, ELENAX reserves the right to charge a cancellation fee of up to 70% of the total agreed cost.
Should a cancellation occur after project launch, a prorated fee may be applied depending on the services rendered. Refunds do not apply to digital services that have already been executed. ELENAX may consider partial refunds only in the rare event of non-performance due to internal failure, subject to management approval.
In the event that the project is delayed or suspended due to the client’s failure to respond or provide incomplete materials for more than 30 days, the project shall be considered abandoned, and ELENAX reserves the right to close the project without refund.
Shipping Policy
While ELENAX primarily provides digital services, certain printed materials or physical event-related items may be arranged upon request. In such cases, shipping or delivery services will be coordinated through third-party logistics providers, and all delivery fees will be the client’s responsibility unless otherwise agreed upon in writing.
Elenax shall not be responsible for delays, loss, or damage incurred during third-party delivery unless Elenax’s proven negligence directly causes such issues.
Privacy Policy
ELENAX is committed to protecting your privacy. We collect only essential personal information (e.g., name, email, company details) to deliver our services effectively. This data is used solely for project communication, execution, and account management purposes.
We do not sell, rent, or trade your information to any third parties. All data is securely stored, and access is limited to authorised team members only. Any promotional or marketing communication will be sent only with your prior consent. You have the right to request access, correction, or deletion of your data at any time.
We retain personal data only as long as necessary for the execution of our services or as required by Malaysian law.
Limitation of Liability
To the fullest extent permitted by law, ELENAX shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, revenue, or data, arising out of or in connection with the services provided. Our total liability, if any, is limited to the amount paid by the client for the specific service in question.
Force Majeure
ELENAX shall not be held liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including, but not limited to, natural disasters, war, government regulations, pandemics, labor disputes, or internet service disruptions.
Governing Law & Jurisdiction
These policies and any disputes arising from our services shall be governed by and construed in accordance with the laws of Malaysia. Any legal action or proceedings arising out of or relating to these terms shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
